I have received mail from TIANJIN HONGYEBOXING IMPORT & EXPORT CO., LTD for potassium nitrate soluble fertilizer. his email id is greendy@hybx-limited.com. Is this company and mails are true and genuine ?

Answer:
Besides the site of hybx-limitd.com, they have another five or more websites:

www.hybx-chem.com & www.hybx-liquid.com for chemical products
http://www.hybx-paper.com/  for paper, 
these six sites all created on July 2014, very new, It's weird that a company owns six(or more than 6) websites. Definitely they are not trustable at all.

From this company, I found another thing kinda interesting. The above websites' owner register the site through this mail address:lajiwzzy@126.com, when I googled this mail, showed a list of websites. 
Well, let's check them one by one. the first is scam, the next two is not valid now, the left are also typical scam sites......

It seems any website related with this mail is not in legal business. I just wanna say we have met a scam expert, he must have make much money. :(

Chemical scam in China, esp in Hebei & Tianjin

The scam I most see is chemical scam. As hebei's chemical industry is well developed in China ( it explains Hebei's heavy air pollution). Those chemical scamers mostly come from Tianjin & Hebei province, like shijiazhuang city, handan city,  which also ruined the reputation of Hebei's chemical industry. I can say over 50% of the chemical trading company from Hebei are scammer.


Listing one case for example: ABC company ordered a container of xxx chemical products from Hebei xxx company, paid 5000 dollars, and  finally after it shipped to destination, the buyer opened the container seal just find the ordered items turned to be water.

Antoher example, someone purchased  product A (white powder type) a total value of 60,000dollars from a chemical trading company, and find shipped products was totally another different product, but just similar in appearence.

Another common case: The buyer ordered and paid, then the supplier disappeared.

China scam of large order Trick / Inquiry Trap

"We are an Import/Export company from Morocco, we have been approached by a Chinese company TIANJIN TAILAI (tjtailai.com) for a certain quantity of organic cosmetic products, after negotiations they asked for notary fees to register the contract, the fees were in percentage 0.6% the amount was around 4000 USD."

Just like the above saying, it's another kind of typical scam in China. First attract foreign buyers with large order, they wont spend many time on the price negotiation, but invite you to China for more discussing. As long as you accepted the invitation, they win half the battle, they would think of different ways asking you to pay them money, like buy present to please the boss, notary fee for the contract, something like that. After you back home, they never respond you. You spend much money, time, effort on the visit, but no orders followed.

Travel Guide to Canton Fair 2014(The 116th China Import and Export Fair)

Canton fair 2014  shall be held during Oct 31- Nov 4, 2014, there are three phases for different kinds products.

Route
Train: If you want to go to the Canton Fair, the route we suggested is flying to Hong Kong and take the train there to Guangzhou, which is generally the most effective and cheapest way. Hung Hom Hong Kong Iternational Trainstation is only 30 minutes away from Hong Kong Airport. There are 12 trains (08:19 -19:24)heads to Guangzhou daily from Hung Hom station, 
Airplane: If you prefer airplane, the flight from Hong Kong to Guangzhou takes around 1 hour, and it takes generally additional 1 hour by taxi from Guangzhou Airport to most hotels downtown.

Business license of China company

Business license is a certificate of a business entity’s identity issued by local AIC (Administration of Industrial and Commerce,the corporate registration agency in China). Every company should be registered in local AIC, it's kinda like Certificate of Incooperation in the US.

Business License provide basic information of a entity,which are: registration No., License No, Company name, registered address, name of the legal representative (the individual who operate business on behalf of the entity), amount of registered capital, actually invested capital, type of the entity, business scope (type of business allowed to do), date of incorporation, expiry date  See the picture belowing.

Usually, there is one original copy and one duplicate copy of business license. According to relevant regulations, the original one has to be put in a conspicuous place in the location where the business is operated. Foreign customers dealing with China companies are advised to asking them directly for a copy of business license, examing the basic information of the entity.

Be sure your supplier deliver his own business license but not belong to other legal company, so pay attention, is the company name the same one that you have always been contacting and showed in P/I or Purchasing contract. In some cities of China, the company's register information can be checked through local official site of AIC.


There are two ways:
One way is visiting official site of State AIC  http://gsxt.saic.gov.cn/
1. First find which province your china supplier is located in, then choose the right one.


2. Input the company's chinese name or register Number in the blank:

3. You'll see the pop-up for verifing. Unfortunately, unless you know Chinese language well, otherwise you'll stop here

4. After you write the right verify code, you'll get the register information of company(if it's a real company)

Another is visiting local AIC website
For example, You wanna examing a company which is located in Wenzhou city (Zhejiang province) 
Here are the steps:

2. Find the link to Company Basic information inquiry(企业基本信息查询) and click it.


3. It direct you to this page, you can enter the company's chinese name or Register No in the blank, press enter.


4. If it is a registered company in Wenzhou city, the result will be displayed as the picture, then click 详细信息

As China is not an English-speaking country, almost 95% of the local goverment don't have English version homepage, it's not convenient for foreigners to check the information. Also, some cities may charging fees for accessing public records.

Tips for traveling in China

1. Avoid the Public holidays in China , as during these holidays, tickets are expensive and hard to buy, most hotels are full, much more time and patience on queue and trafic jam. But if you'd like experience China's tradition, you can't miss some of the holidays.
(public holidays: New year's Day; Spring Festival Day; Tomb-sweeping Day; Labour Day; Dragon boat Festival; Mid-autumn Festival; National Day)

2. Bring with you any OTC medicines you might need, such as pain-killers, Aspirin, or anti-diarrhea medicine, and a small first-aid kit. It may be difficult to purchase these items at your destination due to the lack of availability and the language barrier.

3.Tap water is not drinkable in China, take bottled drink with you. Some public places in small cities don’t offer free toilet paper, carry around the tissue.

4. As the shape of a socket varies between countries, a portable plug adaptor may also be necessary.

5. If you plan go to some small cities, you’re suggested to exchange sufficient RMB(chinese currency) with you through the local bank (working time:9am-5pm), as some hotels might not accept credit cards. And keep the currency exchange receipts in case.

6. If stay in China for a long time, buy a local SIM card for your mobilephone, the SIM card are available in any cell/phone shops. Also can get an IP card, telephone booth is common in big cities.

7. When shopping in market, almost everything is negotiable except in the supermarket or mall. Most sellers will increase the price when facing a foreign buyer, you can cut the price off 50% or more directly.

8. When taking a taxi, take a note of your destination’s adress and phone number both in English and Chinese, as seldom taxi drivers speak English.

9. China is rather safe, but don’t carry around much valuable items, be cautious of the pick pocketing & bag snatching. In case of emergency, call 110 for police, 120 for ambulance.

10. Learn some simple chinese words about saying hello, goodbye and thank you. Don’t be stuck by china’s different manners, chinese will be friendly to your honest mistake.

Buying from China's Factory or Trading company?

When buying from China, you'll meet two kinds of company: Trading company & Real Factory .

Most buyers prefer to deal with factories directly, because factories always give better price. In fact, both have their advantages and disadvantages. Sourcing is not all about price, you got to consider issues like service, professionalism, communication etc, which in many cases, are the advantages of trading company, but the shortcoming of factory. The biggest advantage of factory is Cheaper price. Normally, factories can offer better price than trading companies. Factories control raw material, production, and technology, while trading companies buy from factories and will add their commission onto the factory price. So if the trading company don't have competitive supply chain(in some cases, their associate factories can give extremely competitive price to the trading companies, so even after the trading companies add commission, the price is still competitive compared with other factories, this is rare, but it can happen).

But you might also meet the communicating problem, you know China is not a english-speaking country, the truth is most of the factories donot have enough English-speaking staff at present. In comparision of small factory, trading company hire more educated staff. Another advantage of trading company is they allow small order quantity which factory don't accept.

Another problem is quite a large quantity of Chinese suppliers, especially small and medium sized ones, don’t have import and export certificates, they are exporting through big import and export companies(factories pay 2 to 3% commission to the export company.

So many trading company pretend to be a factory, and sometime you can't easily tell from their company name,They don’t use trading or international trade as company name. One simple way to tell the trading company from factory is to look at their brochure, if a company make from lighting to floor mat then electronics, they are trading companies; another way is checking their business license, which clearly indicates the type of company, though it is in Chinese vision.

Why & How to set up an offshore company in HK

About Hongkong:
Hong Kong's corporate law is strongly based on the British common law. Local businesses are regulated and Hong Kong regards itself as a low tax centre rather than a tax haven. Taxes are levied on profits, salaries and property with varying rates. Each year the company must submit an annual return and penalties apply for late filings and there is an ever increasing vigilance by the Companies Registry for this purpose.

All companies must obtain a Business Registration Certificate from the IRD and are required to file a set of audited accounts with the IRD annually.

Company names may be expressed in both English and Chinese characters.

Tips of signing a formal contract with chinese supplier

Signing a formal Contract of Sale of Real Estate, is the final and most important part of the sale. When the negotiations have concluded, and both parties are satisfied with the deal, it is put in writing in the form of a written and legally Contract, where the parties both have signed under seal.

When signing a purchase/Sale contract, should pay attention to the following items:

1. The importance of detailed specifications
Most quality issues come from miscommunication and misunderstanding. Importers should keep track of all their requirements regarding the product and its packaging. For example, Commodity name, specification: should be expressed in detail and precise, esp for the quality aspect. If the quality has a standard to follow by, should also be described by national standard or industrial standard. Order on the basis of sampls, should keep the sample as the basis of final acceptance
When a good deal of customization is involved, and for large orders, these specifications should be translated in Chinese (for the factory technicians) and included in a contract. When the time comes for product checking, the inspector will use this information as a checklist
Set out clearly what the Chinese company must do to be in compliance with the contract, how disputes are to be resolved, Set out the liquidated damages the Chinese company must pay if it fails to comply with the contract; Many contracts are too vague to allow for effective action by the courts.
After an inspection fails, the supplier usually agrees to repair the problems and support the cost of the re-inspection. Detailed specifications are useful in avoiding endless negotiations with your supplier

2 The purchaser should consider buying insurance against any accidents (e.g. fire) which may result in loss or deterioration in the value of the flat after signing the provisional agreement or the formal agreement. The purchaser takes up the risk of the flat (e.g. any accident causing damage) once the provisional agreement or the formal agreement is signed

3 Have that written contract both in Chinese and English, Many contracts entered into by foreigners are simply unenforceable in China. A typical unenforceable contract is not written in Chinese, not subject to Chinese law and provides for enforcement outside of China.

4 Make sure the company's legal representative signed it, (A signature (in chinese) from the company's legal representative, you can tell who exactly is the company's legal representative from the business license) , and an appropriate seal (also called a chop) is applied to the contract. Once there is dispute, many foreign parties want to base a claim on a complex set of emails, oral communications and practice over time. This does not typically work in China. An aggressive lawsuit based on a clear written contract does work.


Don't expect, Inspect the quality of your orders in China

Usually there are three kinds of QC Inspection: Pre-production QC Inspection, During-production QC Inspection and Pre-shipment QC Inspection.

Pre-production inspection:

This type of inspection is necessary if you want to check the raw materials or components that will be used in production. Buying cheaper materials can increase a factory's margin considerably, so you should keep an eye on this risk. A pre-production inspection might also be a good idea if you suspect that technicians on the factory floor have not been given all the information or have not understood all your requirements.
At the beginning of the production process, do a visual check on the quality of components, materials, accessories, semi-finished and finished products against client specifications and/or reference samples, to predict any possible problems and make recommendations, and so as to verify that your product specifications are being met early

During production inspection:

Send an inspector during production, always check the following aspects:
•The production status during the manufacturing process
•The semi-finished and finished products at random
•The production lines & capability
•The package details and packing material
You can get a good idea of the average product quality, and be able to ask for corrections if problems are found. It can take place as soon as the first finished products get off the line, but these samples might not be representative of the whole order. So usually such an inspection is done after 10-30% of the products are finished. What you benefit from this?
•Be aware of quality issues early, and implement corrective actions before it is too late
•Communicate with your supplier about what is acceptable and what is not
•Get a precise production schedule

How to keep your trade in safe in China

Since China has become the world factory, more businessmen tend to China for sourcing products and supppliers. Unavoidable more scamers also appeared in international trade field. During our working experience, we have met many victims of being scammed by chinese suppliers. 

How to stop the scamer from you, here are some tips for large order:

1. Confirm if the address, phone number and email address given to you by your trading partner belongs to the same company.

2. Check the Partner's Background, in some cities the existence of a company and its legal status is a matter of public record. If you cannot have independent access to your partner's registration information, ask an independent third-party as our company check for you.

3. Visit your partner in person. This would be the direct way to know your supplier, please be accompanied by a chinese assistant, to help you clarify a real or bogus company. Sure you also don't need to fly all the way to China for a visit, apply a third-party do a factory auditing, fully check out your partner would help a lot for a safe trading.

4. Use Pre-Shipment Inspection Services, If you are a buyer, you can protect yourself against poor quality by ordering a pre-shipment inspection of the products. You can demand the inspection from indepent third-party as a condition to payment.

Yiwu is located in Zhejiang Province, about 3 hours from Shanghai by train. The fair takes place in October every year. It's the third largest exhibition sponsored by the Chinese Ministry of Commerce. Last year Yiwu Fair featured more than 3,000 exhibitors and attracted over 110,000 buyers and traders including about 17,000 from overseas.
Yiwu has a reputation as the place to go for low order quantities. Most products are cheaper with lower quality too. Nonetheless, if you need festive, promotional or budget products, Yiwu Fair is a good place to source. I have found good factories at this fair, especially ones that specialize in crystalware, for which Yiwu is famous. A lot of domestic buyers visit Yiwu and English is not as widely spoken as at some other trade fairs.
